Collaborative Law Section
Provides a forum for lawyers and other professionals who are interested in learning about the collaborative dispute resolution process and advancing their skills in the process. The goals of the Section are: (1) to promote the use of the collaborative process for resolving disputes in various areas of law, (2) to train lawyers and other professionals in the use of the process, (3) to educate the public as to the benefits of the process, and (4) to preserve the integrity of the collaborative dispute resolution process.

Topic: "Shall We Dance? Dealing with the Other Party’s Concerns about Collaborative Law”
The panelists will address common objections to the use of collaborative law advanced by the other party and opposing counsel and how to overcome them, drawing from their own experience and from a survey conducted of Dallas area collaborative practitioners.

Topic: "Using Jointly Engaged Experts in a Collaborative Case"
This program will address the circumstances under which parties in a collaborative case might jointly engage an expert, the types of analyses the expert might provide, best practices in working with the jointly engaged expert, traps for the unwary in working with jointly engaged experts, the role of independently engaged consulting experts, and how the jointly engaged expert’s report can be used in the resolution of the case.

Nadine Bell, a Certified Professional Facilitator, will discuss how facilitators who employ effective processes to facilitate complex business meetings, open communication, produce rich brainstorming, and create constructive engagement, can assist parties using the collaborative process to resolve business and civil disputes.

Topic: Interest-Based Negotiations
Janet Brumley, an experienced collaborative attorney and board-certified family lawyer, will discuss how interest-based negotiation differs from position-based negotiation, how to discern the clients’ interests underlying their stated positions and how a desire for a continued relationship can be accommodated in interest-based negotiation, even when it would be decimated by position-based negotiation.

Topic: Soft Landings: Capturing Benefits from the Collaborative Process Even When A Case Doesn't Settle
This program will address what happens when a collaborative case doesn’t settle and one or both parties “opts out” in favor of litigation. Parties in these situations can avoid a “crash landing” by agreeing that they can use some of the fruits of the collaborative process in the litigation. For example, they might stipulate to the opinions and conclusions of a jointly engaged expert, or agree that documents exchanged will be treated as having been produced in discovery. This presentation will discuss different ways of capturing the benefits of the collaborative process in a subsequent litigation, drawing from the personal experience of the speakers.

Jeanne is a business and employment litigation attorney in San Francisco who has worked with CPR and other groups to expand the use of the collaborative process. Anne is an attorney, mediator and arbitrator who is a regular speaker and trainer on the collaborative process. Both Jeanne and Anne have experience practicing in state and federal court.

Interest-based negotiation is catching on like “wildfire,” growing locally, nationally, and internationally in numerous formats. John Lande, Director of the LLM Program in Dispute Resolution and Isidor Loeb Professor at the University of Missouri School of Law, and author of numerous articles and publications on interest-based negotiation, including Lawyering with Planned Early Negotiation: How You Can Get Good Results for Clients and Make Money(ABA, 2011), and Camille Milner, North Texas collaborative Lawyer, mediator, and frequent speaker on developing and expanding interest-based negotiation, including her 2011 State Bar of Texas/Collaborative Law Institute of Texas Spring Conference presentation, “Expanding Our Horizons: Creative Ways to Grow Your Collaborative Practice,” will speak on innovative ways to incorporate interest-based negotiation into your law and mediation practices. Their presentation will include what Prof. Lande calls “Planned Early Negotiation,” what Judge Frank Evans (the father of mediation in Texas) has termed “Managed ADR”, cooperative law, and (of course) collaborative law.
